Terms of Use

These Terms of Use govern the rights, obligations, and responsibilities between Photostories ("Photostories", "we", "us") and you in connection with your use of the Service. By registering for or using the Service, you agree to these Terms.

Article 1 (Purpose)

These Terms set out the conditions and procedures for using the Photostories service (photostories.co and its related subdomains, the "Service"), and the rights, obligations, and responsibilities of Photostories and its users.

Article 2 (Definitions)

• Service: the online service we provide that lets you publish photos and stories and share them on your own public site (your-handle.photostories.co).
• User: a member who uses the Service under these Terms.
• Content: photos, text, and other material you upload or create on the Service.
• Handle: the unique identifier assigned to you, used as your subdomain address (your-handle.photostories.co).

Article 3 (Effect and Amendment of the Terms)

• These Terms take effect when posted within the Service.
• We may amend these Terms within the limits of applicable law.
• If we amend the Terms, we will give advance notice of the changes and their effective date. If you continue using the Service after the effective date, you are deemed to have accepted the amended Terms.

Article 4 (Eligibility and Account)

• You must be at least 14 years old to use the Service. A minor must use it with the consent of a legal guardian.
• You register through our authentication provider and supported social logins.
• You are responsible for keeping your account secure and for all activity under it.
• Each account is for one person; do not share your login credentials.
• Notify us at supportphotostories@gmail.com immediately if you learn your account has been used without authorization.

Article 5 (The Service)

• We provide tools for you to create, customize, and display photo stories as a public site, gallery, and map.
• You decide whether each story and photo is public or private.
• We may add, change, or discontinue features to improve the Service.

Article 6 (User Content and License)

• You retain all rights, including copyright, in the Content you upload; we do not claim ownership of it.
• To operate, provide, and promote the Service, you grant us the right to store, reproduce, technically adapt (such as resizing and format conversion), publish, display, and distribute your Content, to the extent necessary. This right also extends, for the same purposes, to the third parties we use to run the Service (such as hosting and image-storage providers).
• If you set Content to public, anyone may view it and it may be indexed by search engines.
• We may use portions of your public Content (such as a cover image and title), with attribution to you, to introduce and promote the Service.
• You represent that you hold the necessary rights to the Content you upload and that it does not infringe anyone's rights or violate any law. If your photos include identifiable people, you are responsible for obtaining any required consents.

Article 7 (Prohibited Conduct)

You must not:

• post content that is illegal or promotes illegal activity;
• infringe anyone's intellectual property, privacy, publicity, or other rights;
• post sexually explicit or pornographic content (artistic nudity is allowed, but we may restrict it at our reasonable discretion);
• post content that sexually exploits or endangers minors;
• engage in hateful, harassing, threatening, or defamatory conduct, or incite violence;
• disclose another person's personal information without consent;
• distribute malware, hack, disrupt the Service, scrape data, or circumvent access controls (including copy-protection);
• impersonate any person or misrepresent your affiliation;
• engage in spam, deception, or fraud.

We are not obligated to monitor Content, but we may review, remove, or restrict Content or accounts we believe violate these Terms or the law.

⚠ If you engage in prohibited conduct, we may suspend or terminate your account without prior notice, and fees already paid will not be refunded.

Article 8 (Handles and Subdomains)

• We assign you a handle and a corresponding subdomain (your-handle.photostories.co).
• A handle is a convenience, not property; choosing one gives you no trademark or other rights in it.
• You may change your handle subject to limits we set (such as a waiting period). When you do, your previous handle is released and may be taken by another user, and we do not provide redirects from it.
• Some handles are reserved. We may reclaim, rename, or disable a handle that violates these Terms, infringes a trademark, impersonates another, or is used unlawfully, or as needed to operate the Service.

Article 9 (Paid Plans and Payment)

• We offer a free plan and paid subscription plans ("Paid Plans").
• Paid Plans are billed in advance on a recurring basis and automatically renew for the same period (monthly or yearly) until you cancel.
• Payments are processed through third-party payment providers. Depending on your location, your purchase may be handled by our domestic payment provider (where we are the seller) or by an overseas Merchant of Record; that provider's terms also apply.
• You may cancel a Paid Plan anytime from your account; cancellation takes effect at the end of the current billing period.
• We may change prices or features; price changes take effect at your next renewal after advance notice.

Article 10 (Withdrawal and Refunds)

• You may request a withdrawal (full refund) within 7 days of the payment date.
• Refunds are issued to your original payment method. We process them within 3 business days of confirming your request; actual posting may take additional time depending on the card issuer or payment gateway.
• After 7 days from the payment date, refunds are not available; you may cancel your subscription anytime to prevent the next renewal.
• If your account is suspended or terminated for violating these Terms, no refund is provided even within the 7-day period.
• The free plan involves no payment and is not subject to refunds.

Article 11 (Copyright Complaints and Content Management)

• If you or a third party believe Content on the Service infringes your rights, report it to supportphotostories@gmail.com.
• Please include (1) your contact information, (2) the work you claim is infringed, (3) the URL of the allegedly infringing Content, and (4) a statement that you are the rights holder or authorized to act for them.
• We may remove Content in response to a valid report and may terminate the accounts of repeat infringers.

Article 12 (Suspension and Termination)

• You may delete your account anytime from your settings. Deleting your account removes your stories, photos, and site; some data may remain briefly in backups and then be deleted, and information required to be retained by law will be kept for that period.
• We may restrict your use or terminate your account if you violate these Terms or the law, where required for security or legal reasons, or if we discontinue the Service.
• If your account is terminated because you violated these Terms, fees already paid are not refunded.

Article 13 (Limitation of Liability)

• We are not liable where we cannot provide the Service due to force majeure such as natural disasters.
• We are not liable for service disruptions caused by reasons attributable to you.
• We are not liable where Content you uploaded infringes another's rights; that responsibility rests with the user who uploaded it.
• We do not intervene in, and are not responsible for, disputes arising between users, or between a user and a third party, through the Service.
• The Service is provided "as is"; we do not warrant that it will be uninterrupted or error-free or that Content will be preserved without loss. You are responsible for keeping your own copies of your Content.

Article 14 (Privacy)

• We protect your personal information in accordance with applicable law. How we collect, use, and store personal information is set out in our Privacy Policy.
